Sujit Choudhry’s Take on Constitutional Challenges in Ukraine

On July 10th, the director of the Center for Constitutional Transitions, Sujit Choudhry, joined a team of constitutional experts in Kiev in a roundtable discussion. The top constitutional experts analyzed Ukraine’s semi-presidential system of government and the inherent challenges currently facing it.

The workshop was hosted by notable think tanks in Ukraine and inter-governmental organizations in support of sustainable democracy in the world. With him were distinguished personnel who have vast knowledge in the matter of discussion.

During the event, Sujit Choudhry acknowledged that it was a privilege to be in the presence of experts discussing executive powers. He also noted that the instability in democratization in Ukraine is a result of a concentration of presidential powers, weak political parties, and the legislature electoral system.

He also touched on the involvement of transitional democracies in constitutional decision-making. He noted that it was essential for legal thought leaders to gather and discuss policy-based options to aid the constitutional reform process.

About Sujit Choudhry

Born in 1970, Sujit Choudhry is a dean at the University of California at its Berkley Law School where he also serves as a Professor of law. Sujit Choudhry the Constitution Law Guru

Due to the present crisis in Catalonia, Sujit Choudry and other leading constitutional scholars were compelled to write an open letter to Spanish and Catalan governments with the hope that the two governments have an honest discussion on their constitutional matters. The scholars asked Puigdemont, Catalonian President to show his commitment to the mission of seceding from Spain by organizing a referendum that backs up the desires of the people of Catalan.   Related article on

They went ahead requesting Prime Minister Rajoy of Spain to admit that secession is what a good number of Catalans want and not to try to suppress their desire to express it peacefully, They further, affirmed that the two sides need to arrive at a constitutional agreement that caters for the rights of the two governments. However, Mr. Puigdemont decision of postponing Catalonian’s announcement of independence so as to have a dialogue with Spain ought to be seen as a right decision.

Sujit Choudhry and the authors believe that the Spanish government did all they could to suppress voter turnout. The scholars believe that Mr. Rajoy doesn’t care about the wishes of the Catalonian people, he instead handles this difference in a cruel method which is not the case in global law and if this does not cease it would lead to abuse of human rights. They consider the right direction for Catalan and Spain is having a dialogue that includes the true wishes of the people of Catalan.

Sujit Choudhry: The Constitution in His Hands

Sujit Choudhry was the first dean at Berkley Law School who is of Indian descent. He is currently the I. Michael Heyman Professor of Law at the University of California. He is widely known for his authority on comparative law. Choudhry did biological studies at McGill University but abandoned that course to follow his passion; Law. He obtained a law degree from Oxford University then later masters in Law from Harvard School of Law.

His incredible knowledge in the law field has firmly secured his name both locally and internationally. He has a world of experience in the process of constitutional building. He has served as a constitutional building advisor in Libya, Egypt, Nepal, South Africa, Ukraine, and Sri Lanka.
