Sujit Choudhry Expresses his Thoughts about the Constitutional Instability of Ukraine

Sujit Choudhry, an internationally recognized constitutional expert, expressed his thoughts about the constitutional instability of Ukraine. He was speaking at a workshop conducted in Kiev, the capital of Ukraine, on July 10 with other scholars were also expressing their views. The workshop was focusing on various constitutional challenges and the semi-presidential system of the country. The workshop was conducted by the Center for Policy and Legal Reform – a Ukrainian think tank– and International IDEA – an organization working for sustainable democracy across the world.

Choudhry noted that multiple factors contribute to the unstable condition of the Ukrainian democracy with too much power concentrated in the hands of President being the primary reason. Though the executive branch has a prime minister, President assumes excess powers that remove the possibility of proper checks and balances – leading to rampant corruption. Also, the electoral system for the legislature is poorly designed, and the political parties are very weak. The separation of powers between President and the Prime Minister is another major issue as many of the executive powers are either overlapped or not clearly defined. Sujit Choudhry stated that clear separation of powers should be constituted for a stronger democracy. He joined with other experts and discussed on various solutions including the design of a clear and transparent semi-presidential system for the country as it can be more productive and meaningful. It would limit the presidential powers and ensure a constitutional stability. Additionally, it can strengthen the weak Ukraine legislature and make it capable of putting checks on both government and the President.
